Dossier Arafat: un élément nouveau

Nos lecteurs trouveront ci-dessous le courrier en français et en anglais qui nous a été adressé par Maître Michel A. Nous avons trouvé dans le cadre de la procédure judiciaire pénale en cours un élément capital que nous souhaitons apporter aux lecteur de votre Blog: L'AVEU EXTRAJUDICIAIRE


Le livre, Le dossier Arafat, de Maîtres Karin CALVO-GOLLER et Michel A. CALVO, publié en France par Albin Michel, exposait de manière détaillée le rôle et la responsabilité de Yasser Arafat et des Membres de l'Autorité Palestinienne, dans la vague ininterrompue des attentats suicides commis en Israël, depuis le début de l'Intifida.

La presse nationale écrite et audiovisuelle française a boycotté ce livre, qui reprennait des éléments de la procédure pénale engagée en France contre Yasser Arafat et d'autres personnes. Parmi elles des Ministres de l'Autorité Palestinienne.

Nombreux sont en Israël ceux qui croient que l'Autorité Palestinienne a planifé, déclenché l'Intifada et donné l'ordre de commettre des attentats suicide et autres contre la population civile Israélienne.
En France, les informations données dans les médias, n'ont pas mentionné cette éventualité, voyant dans l'Intifada un soulèvement spontané.

Aujourd'hui une réponse claire à ces questions a été apportée par ces avocats, dans leur livre que nous vous invitons à nouveau à lire, mais aucun média ne s'en est fait l'écho.

Après une recherche difficile Me. CALVO a trouvé récemment une déclaration de Mahmud Abas - Abu Mazen.

Récemment, le 14 février 2005, dans une interview-déclaration, à la Télévision de l'Autorité Palestinienne, Mahmud Abbas - Abou Mazen a fait un aveu, qui est passé innaperçu par tous les médias. Il a dit: 

"qu'il faut libérer les prisonniers; ce sont des êtres humains qui ont fait de que nous leur avons cmmandé de faire, nous, en tant qu'autorité palestinienne... Il s'agit d'une guerre -la guerre des guerres-. En temps de guerre, vous donnez ordre à vos soldats de tuer; moi, j'ai doné ordre à mon fils, à mon frère, bref à quiconque, d'accomplir son devoir de résistant. Dans les deux cas, qu'il s'agisse du soldat ou du civil, l'un et l'autre ont tué...Il faut libérer les prisonnier, il faut libérer les déportés... Sinon, que voulez-vous que je réponde au citoyen ordinaire lorsqu'il me dira: "Voilà où j'en suis aujourd'hui; c'est toi qui m'as donné l'ordre d'agir, c'est donc toi qui est responsable de mon sort ?..."

Rappellons que Mahmud Abbas-Abou Mazen a été premier ministre et ministre de l'intérieur de l'Autorité Palestinienne de mai à septembre 2003. Durant ses fonctions, 78 personnes ont été assassinées.  Il a été Vice Président du Fatah, membre et secrétaire général du comité exécutif de l'OLP, Chef du départment des réfugiés et négociations.
Il est actuellement Président du Fatah, Président de l'OLP et Président de l'Autorité Palestinienne, depuis le 15 janvier 2005.

Il semble ignorer que tuer des civils constitue un crime contre l'humanité.

Cet aveu extra judiciaire exceptionnel, sur des faits jusqu'à ce jour niés et sur sa responsabilité et celle de tous les membres de l'Autorité Palestinienne qui se sont succédés peut être vu et entendu sur le site internet www.ledossierarafat.com (clickez sur "Interview de Abou Mazen"). Une transcription en Arabe se trouve également, avec une traduction en Français par un traducteur -interprètre juré assermenté près les Cours d'Appel, une traduction libre en Anglais et une traduction en Hébreu effectuée à la demande des avocats par le Palestinian Media Watch, qui je vous le rappelle suit et enregistre quotidiennement les émissions  de l'Autorité Palestinienne.

The book, Le Dossier Arafat (Arafat’s File), written by Dr Karin CALVO-GOLLER and Dr Michel A. CALVO, published in French by ALBIN MICHEL, detailed the role and responsibility of Yasser Arafat and Members of the Palestinian Authority in the waves of suicide bombing and other lethal attacks on the Israeli civilian population, since the beginning of the Intifada.

More and more people, in Israel, considered that the Palestinian Authority planned the Intifada and gave orders to kill civilians, in violation of international criminal laws. European and American media did not evaluate this possibility.

Dr Michel CALVO, an Israeli attorney, filed with French lawyers a criminal claim against Yasser Arafat and other members of the Palestinian Authority in France, in the name and on behalf of French victims of terror.

After an investigation Dr CALVO succeeded to find a interview – declaration of Abu Mazen – Mahmud Abbas, on the Television of the Palestinian Authority, broadcast on February 14, 2005, which remained unnoticed by all international media. This declaration constitutes certainly and out of court admission and one could question whether or not, after such an admission of guilt, negotiations could continue to take place with someone and other who should be brought for trial before the International Criminal Court in Den Haag. More that 1000 people died during the Intifada, most of them israeli civilians. To this number one must add palestinians who were killed as a result of the Intifada.

If I understand well the Israeli Public opinion toward our cause, toward our people has changed positively. Its reconsiders our position, it has a different view: What is the message that you want to convey to the Israeli Public?

Mahmud ABBAS

…. When I call for the release of the prisoners (of war), this means that they must be released; these are human beings who did what we ordered them to do, we, as Palestinian Authority and consequently, it is not fair to punish them for that, at the same that we meet around the same table to speak and to negociate. Beside, they have been imprisoned for years. For  how long will they stay in prison? All their life? They have been are been judged, they have been a long time away from their friends and their families; It is enough. This is the message that I send to the Israeli public opinion. The Israeli people must express his authority, he must exert pressure on his government, he must stage demonstrations in the streets. He must demand the release of our prisoners, the withdrawal from Gaza, and from the West Bank and the other regions. The Palestinian people should not remain vanquished and occupied for ever…

Muhammad AL BAZ:

Mr. President, how could we deal with their (Israelis) demands and their talks concerning those who have blood on their hands?

Mahmud ABBAS

…Well, let us be clear; It is a war – the war of the wars – In time of war, you give the order to your soldiers to kill; So, I gave the order to my son, to my brother, and to everybody, to accomplish his duty of resistance. In both case, in the case of the soldier or of the civilian, both have killed. Thus, you must not come and say to me that they must stay in prison because they have their hands stained with blood.

They are fighters, and like any human being who fights in a time of war, - and there were wars everywhere in the world - when there is a truce, we must forget the past;  This applies also to the prisoners, to the deported. They must all be freed. If this is not done, what will be the meaning of peace? It’s enough, it’s the end. The prisoners must be release, the deportees must be freed…. If this is not the case, what do you want me to answer to the ordinary citizen will ask me:   “Here is where I am today; That is you that ordered me to act, thus you are responsible of my fate”?

Abu Mazen - Mahmud Abbas was Prime Minister of the Palestinian Authority from May through September 2003. During his functions 78 persons were assassinated. He was Vice President of the Fatah organization, Member and Secretary General of the PLO executive Committee and Chief of the Refugees Department.

He seems to ignore that killing civilians constitutes a crime against humanity.
